Studio 99 cares about You, and data collection.

Studio 99 endeavors to protect the privacy of users of its website. Please read this Privacy Policy carefully and in full before contacting Studio 99 or otherwise using the website at www.webstudio99.com.

Article 1. Definitions

In this Privacy Policy, the following definitions apply:

Contract: The Contract between a Client and Studio 99 concerning the purchase and delivery of services.

Personal Data: Personal Data is any information concerning an identified or identifiable natural person or business entity, that is processed by Studio 99 as described in Article 3 of this Privacy Policy.

Privacy Policy: the present Privacy Policy.

Processing: An operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;

Controller: The natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Data;

Processor: The person who processes Personal Data on behalf of the controller, without being subject to his direct authority.

Website: With ‘Website’ the website: www.webstudio99.com is meant.

Website visitor: The Website visitor refers to the person who uses the Website of Studio 99.

Article 2. Scope of the Privacy Policy

2.1 This Privacy Policy applies to every use of the Website and governs the processing of Personal Data via the Website. Studio 99 is the Controller for this processing.

2.2 The Website of Studio 99 contains references to websites of third parties (for example hyperlinks, banners, or buttons). Studio 99 is not responsible for compliance with the Applicable Privacy Legislation by these third parties.

Article 3. Personal/Company data collected

3.1 Studio 99 processes the following Personal/Company Data from Website Visitors and Clients:

3.2 These Personal/Company Data are collected by requesting a Studio 99 cost estimate, registering on the Website, directly ordering a service, or otherwise using the Website.

3.3 Studio 99 will only process the Personal/Company Data in accordance with the Applicable Privacy Legislation.

3.4 Studio 99 will only use your Personal/Company Data as described in this Privacy Policy.

Article 4. Purposes and legal ground for processing

4.1 Studio 99 collects and processes your Personal/Company Data solely for the purposes specified below:

1.a. Performance of a Contract: If you decide to place an order, your Personal/Company Data will be processed by Studio 99 for the performance of the Contract. This includes the handling of the payment and the delivery of the products.
No more Personal/Company Data are processed than strictly necessary for the performance of a Contract (Article 6 paragraph 1 section b GDPR).

1.b. Communication: Your Personal Data are used to communicate with you about your order/company and to inform you of matters that are important for your account and/or use of the Website and the handling of any complaints.
This Processing of entering Personal/Company Data is necessary for the performance of a Contract (Article 6 paragraph 1 section b GDPR) and/or for purposes of a legitimate interest pursued by Studio 99, namely to conduct its normal business (Article 6 paragraph 1 section f GDPR).

1.c. Marketing purposes: Your Personal/Company Data can be used to reach out to you for inspirational purposes (by e-mail or by phone). If you have asked for it we will send you a cost estimate, with regard to the information provided on your project/company project.
Studio 99 does not process emailing at the moment but reserves the right to do so. Therefore, you always have the option to unsubscribe from mailings. This Processing of Personal Data is based on consent (article 6 paragraph 1 section a GDPR) or is necessary for purposes of a legitimate interest pursued by Studio 99, namely to perform marketing activities (article 6 paragraph 1 section f GDPR).

4.2 If Studio 99 intends to further process the Personal/Company Data for a purpose other than that the Personal/Company Data has been collected, Studio 99 will provide you with information about that other purpose and all relevant further information before that further processing.

Article 5. Transfer of Personal/Company data by third parties

Studio 99 shares Personal/Company data with the following entities:

A/ WordPress (Website is powered by WordPress)

B/ Google Analytics (see article Studio 99 only uses third-party cookies to improve the quality and effectiveness of the Website. For example, it uses Google Analytics through WordPress. These cookies collect information about how you use and move around on our Website. For example, these will keep track of what pages are most visited, internet protocol (IP) address, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. When you access our Website, a banner might be displayed informing you which cookies will be installed if you continue browsing on our Website. If you click on “I agree” on the banner, you are giving your consent to use Google Analytics. The collected and processed data expires after the end of the browser session and after two years from the set/update. Article 6. Security

6.1 Studio 99 takes appropriate organizational and technical security measures to protect your Personal/Company Data and to prevent misuse, loss, or alteration thereof.

6.2 Studio 99 stores your Personal/Company data through WordPress, which agrees with these parties’ standard data protection provisions set by the European Commission.
A copy of the agreed standard provisions can be requested by the Website Visitor or Client via WordPress following those steps:

  1. Visit https://wordpress.org/about/privacy/data-export-request/.
  2. Enter your email address.
  3. Click “Accept Declaration and Request Export”.
Article 7. Storage periods

7.1 Studio 99 does not store the Personal/Company Data of Website Visitors longer than strictly necessary in relation to the purposes for which they are processed. Except where there is a legal retention term;

7.2 You can request Studio 99 to erase the Personal/Company Data earlier. If the Personal/Company Data is no longer necessary in relation to the purposes for which Studio 99 has collected or otherwise processed the Personal/Company Data, Studio 99 will erase the Personal/Company Data.

Article 8. Social media

Studio 99 uses WordPress to connect with various social media platforms. By logging in to their social media account via this plugin, Visitors to the Website can like and share products with others. Studio 99 will not have access to the social media accounts nor to the Personal/Company Data on the social media of the Website Visitor.

Article 9. Scope of Your Obligations to Provide Data

Generally, Visitors/Clients are not obliged to provide Studio 99 with their personal/company data. However, if you do not provide this information, we will not be able to make a free cost estimate available to you, answer your questions, and enter into a contract with you or your business. Personal/Company data that Studio 99 necessarily requires for the above-mentioned processing purposes are marked as mandatory information by a “*” or another symbol.

Article 10. Your rights

10.1 You can request Studio 99 at all times to view, correct, rectify, supplement, delete, or restrict your Personal/Company Data if these are factually incorrect, incomplete, or if they are processed in violation of a legal obligation. In so far as the data processing is based on consent (see above), you have the right to withdraw this consent at any time.

10.2 You can request Studio 99 to obtain the Personal/Company Data that you have provided to Studio 99 in a structured and commonly used form so that you can transfer the data to another controller. You are only entitled to this insofar as the processing is based on consent in the sense of Article 6 paragraph 1 section a GDPR or Article 9 paragraph 2 section a GDPR or if it concerns a processing that is based on the performance of a Contract as referred to in Article 6 paragraph 1 section b GDPR and the processing is carried out by automated means.

10.4 Studio 99 will provide you with information about the follow-up given to the request immediately and in any case within 48 hours of receipt of the request (with the exception of weekends).
Depending on the complexity of the request and the number of requests, this period can be extended to one week (with the exception of weekends). Studio 99 will notify you of such an extension within 48 hours of receipt of the request (with the exception of weekends).

10.5 If your requests are manifestly unfounded or excessive, in particular, because of the repetitive character, Studio 99 will either charge you a reasonable fee or refuse to comply with the request.

Article 11. Right to object

You have the right to object to the processing of your Personal/Company Data at any time. Insofar as the processing of your Personal/Company Data takes place for direct marketing purposes, Studio 99 will always honor your request. For processing for other purposes, Studio 99 will also cease processing, unless it has compelling legitimate grounds for the Processing which override your interests, rights, and freedoms or that are related to the institution, exercise, or substantiation of a legal claim.

Article 12. Data protection authority

You have the right to lodge a complaint with a supervisory authority, in particular in the EU Member State of your habitual residence, place of work, or of an alleged infringement of the GDPR at all times.

Article 13. Automated Decision making / Profiling

We do not use automated decision-making or profiling (an automated analysis of your personal circumstances).

Article 14. Miscellaneous

14.1 Studio 99 is entitled at all times to not answer you or your request without notice if the character of your request or if your Personal/Company data are of any discrimination matter in regards to the E.U. law. In such a case, Studio 99 owes no explanation to the Client as a result of the termination of the request handling.

14.2 If a provision from this Privacy Policy is in conflict with the law, it will be replaced by a provision of the same purport that reflects the original intention of the provision, all this to the extent legally permissible. In that case, the remaining provisions remain applicable unchanged.

14.3 Although most changes are likely to be minor, WordPress.org may change its Privacy Policy from time to time, and at WordPress.org’s sole discretion. WordPress.org encourages visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.
